Frequently asked questions

Line 14

We're happy to answer any questions or queries you might have when it comes to your enquiry. Here are some that our other clients found useful.

Is it possible to borrow against probate?

Yes, it is possible to borrow against probate through what is known as a probate loan or estate loan. This type of loan allows heirs or beneficiaries to access a portion of their inheritance before the probate process is completed, which can often take several months or even years.

How does a probate loan work?

A lender typically assesses the value of the inheritance and offers a loan based on a percentage of that amount. Once the probate process is finalised and the estate is settled, the loan is repaid from the inheritance proceeds.

This option can be useful for covering immediate financial needs or freeing capital for estate-related expenses. However, it's essential to be mindful of potential fees and interest rates and not take on more debt than you can afford.

chevron

How much could you borrow?

Lenders typically offer loans ranging from 25% to 60% of your expected inheritance value. For example, if you are set to inherit £100,000, you might be able to borrow between £25,000 and £60,000.

The lender will evaluate the estate’s total worth, including assets such as real estate, investments, and personal property, along with any liabilities the estate might have, such as debts or taxes.

They’ll also consider the likelihood of a smooth probate process—if the estate is large, complex, or subject to disputes, the loan amount may be lower or come with higher interest rates due to increased risk. Some lenders may also require documentation, such as a copy of the will, probate court documents, or a statement from the executor verifying your inheritance.
